Terms of Use

This Radiant Ride Internet site is owned and operated by Radiant Ride, Inc. By using this site, you agree to the following terms and conditions. We reserve the right to modify, adjust or otherwise change the content or function of this site and these terms and conditions at any time. New or revised terms of use will take effect when posted on this site. YOUR CONTINUED USE OF THIS SITE ESTABLISHES YOUR AGREEMENT TO BE BOUND BY THESE TERMS OF USE, AND ALL ADDITIONS AND REVISIONS TO THEM.

 

Requirements for using this site

This site offers access to cosmetic car care repairs (the “Service”), which enables you, the subscriber, to receive repair services through our dealership network or mobile service network. To use the Service, you must have the authority to charge the credit card or checking account you are using. If you are under 18 years of age, you must obtain the authorization of your parent or other responsible adult before making payments on this site.

 

 

Payment of Charges

You may use this Service for cosmetic reconditioning repairs, and the service charges described below, (mobile road fees or coverage vehicle transfer) by credit card. Your credit card company or bank will make payment to Radiant Ride. By the end of the business day following receipt of funds, Radiant Ride will post a payment to your account. You agree to indemnify and hold Radiant Ride harmless from any liability concerning such payments.

 

Service Charges

When you use this Service to pay, Radiant Ride may add a service charge for your use of Mobile Techs traveling outside their coverage area (a “Service Charge”). Service Charges are paid to Radiant Ride. If a service charge applies to your transaction, you will be informed of the amount of the Service Charge prior to completing your transaction, and you will be given the option to either cancel the transaction and thus not incur any Service Charge or to proceed with completing the transaction. The Service Charge is not a fee or charge assessed by your institution. BY USING THIS SERVICE YOU AGREE TO PAY ANY ASSOCIATED SERVICE CHARGES. The service charge is not refundable, even if the payment to which it relates is canceled, refunded, credited, or charged back.

 

Cosmetic Reconditioning Repair Limits and Conditions

 

Paintless Dent Repair

(PDR) is a process that uses specialized hand tools to gently push the dented metal back to its original form. This process permanently removes door dings and minor dents without harming a vehicle’s factory finish. Dent & Ding (PDR) does not include services that involve the replacement of vehicle body panels or sanding, bonding, or repainting. This program covers only the vertical surfaces of the vehicle. To access the service, please contact Radiant Ride to schedule your appointment. (Maximum dent/ding size 2” diameter) PDR Exclusions: We do not provide coverage for: Large or deep dents. Dents that are inaccessible due to: a) the existence of after-market equipment, or b) where such after-market equipment or the installation thereof has altered the original configuration, or c) Edges where it is determined that the manufacturer’s bracing does not allow for the PDR process. Repairs to creased metal or any area where the paint is damaged. Repairs to any dent and dings that if repaired, could in any way damage the vehicle’s paint or finish. Weather-related damage is not covered, d) any pre-existing condition on the subject vehicle.

 

WINDSHIELD REPAIR PROTECTION

Covers the cost of repairs of the front windshield ONLY of minor chips caused by propelled rocks or other road hazard debris such as wood chips, metal parts, plastic or composite scraps, or any other propelled object NOTE: This covers only minor repairable chips and cracks. Windshield Repair Exclusions: Stress cracks or cracks over one (1) inch are not covered. You must contact Radiant Ride prior to repair. Failure to use our network will void this coverage. Coverage is strictly for road hazard debris damage. Weather damage is not covered. Under no circumstances will Radiant Ride pay for windshield replacement, even if the damage was initially repairable. Windshield cracks in line of sight may be prohibited.

 

COSMETIC WHEEL REPAIR

Covers the cost of cosmetic damage to the Covered Vehicles wheels, that do not affect the performance of the wheel (e.g. scuff mark or scratches) and is damaged as a result of a Road Hazard. A Road Hazard, for the purposes of this service, is a hazard that is encountered while driving a motor vehicle on a public roadway and that may include but is not limited to; potholes, rocks, debris, metal parts, glass, plastic, curbs, or composite scraps. Coverage is limited to the cost of repair by a professional wheel repairing company. Covers Alloy Wheels ONLY. Alloy Wheels are defined as any road wheel composed of either aluminum or magnesium, as opposed to steel, excluding chrome wheels, polished aluminum wheels, and alloy wheels with a machined surface. NOTE: WE RESERVE THE RIGHT TO INSPECT ANY DAMAGED WHEEL PRIOR TO REPAIR. This is not wheel & tire replacement coverage. Cosmetic Wheel Exclusions: This Contract does not cover: a) Any damage that occurs outside the United States, b) Any damages caused by wheel cleaners or chemicals, c) Any damage resulting from off-road use, racing, collision, chain damage, misuse, abuse, lack of proper maintenance per the manufacturer guidelines, suspension problems, use on construction sites or on roads not regularly maintained, vandalism or malicious mischief, theft, fire, or loss covered by physical damage insurance, d) Any damage caused by driving on tires that are improperly inflated, e) Any damage to wheels which are undersized or otherwise not recommended by the vehicle manufacturer, f) Any damage to wheels transferred from another vehicle subsequent to the effective date of this coverage, g) Any damage to “aftermarket” wheels as those defined as those that are not manufactured by the original vehicle manufacturer, h) Any damage that is the result of manufacturer’s defect, i) Any consequential loss or damage whatsoever, including loss, damage, or injury to persons or property resulting from the failure of any parts of the vehicle described herein, the repair of which are covered under the terms and conditions of this program, j) Any loss where You or any person on Your behalf falsely swears or commits and fraudulent act with respect to any claim, k) Any wheel repair that is not preauthorized, l) Any damage that is reported to us after 60 days from the date the damage occurs, m) any pre-existing conditions or damage.

 

PAINT TOUCH-UP REPAIR:

Should the original OEM paint finishes become damaged due to rock chips, scratches, small spots on panels, moldings, or mirrors, or weather-induced oxidation, We will perform Paint Touch-Up to the damaged area. Paint Touch-Up is a process of hand-applying automotive paint using a small “touch-up” brush or apparatus. Paint Touch-Up is a cosmetic repair, not a body shop refinish. As a result, Paint Touch-Up will not match an OEM original finish. Due to air quality restrictions, spray paint repair is prohibited. Paint Touch-Up Exclusions: This Limited Warranty does not cover damage caused by abuse, vandalism, fire, flood, wind, lightning, hale, stone or sand chipping, abrasion, damage caused by vehicle accident, alterations to the original factory paint finish, defective paint, clear coat paint flaking or chipping, rust or misuse. Modifications or alterations of the factory’s original painted finish (i.e. repainted surfaces, aftermarket pin striping, etc.); defective paint (i.e. peeling or chipping of paint or factory clear coat, paint separating, cracking or flaking, or as determined by independent inspection or factory bulletins) are not eligible for coverage.

 

INTERIOR LEATHER/VINYL RIPS & TEARS

Should the leather and or vinyl of seats become damaged as a result of normal wear and tear, including but not limited to; accidental rips, tears (less than 1” inch long) and or punctures (less than 1” inch in diameter), We will repair the damaged area without charge to the vehicle owner. Please note: Rips, Tears, and Puncture coverage is limited to cleaning, repairing, and/or replacing the damaged vinyl/leather surfaces. Interior Leather/Vinyl Rip & Tear Exclusions: Does not cover headliner or steering wheel. We reserve the right to professionally detail (i.e. clean, dye, or repair) any interior claims prior to any other remedies. Our repair obligations shall be limited to cleaning, repairing, and/or replacing the damaged leather/vinyl surfaces with either an upholstery insert or replacement of the seating component and may not include replacement of the entire seat cover, seat back, or armrest. Any repair undertaken without authorization from Us will not be reimbursed. Floor mats or any repair resulting from a cigarette burn are excluded.

 

INTERIOR FABRIC CARPET REPAIR

Should the fabric/carpet areas of the seats or interior trim of the vehicle become damaged as a result of normal wear and tear, including but not limited to; spills of water, coffee, bleaches, dye, sodas, milk, baby oil, lubricating oils, or greasy products, We will repair the damaged fabric/carpet without charge to the vehicle owner. Please note: for bleaches and dye stains, We will pay to professionally clean and re-dye the damaged portion of the vehicle. Interior Fabric/Carpet Exclusions: Does not cover the headliner. We reserve the right to professionally detail (i.e. clean, dye, or repair) any interior claims prior to any other remedies. Our repair obligations shall be limited to cleaning and may not include replacement. Any repair undertaken without authorization from Us will not be reimbursed. Floor mats or any repair resulting from a cigarette burn are excluded.

 

HEADLIGHT RESTORATION PROTECTION

Should the original gloss headlight surface of your vehicle become dull due to normal wear and tear, including but not limited to; oxidation, fading, or loss of gloss, We will repair such condition free of charge. Headlight Restoration Exclusions: We reserve the right to attempt repair through professional detailing. Coverage does not include replacement of headlight and is not applicable if the headlight is cracked or has a hole in it.

 

CONTRACT EXCEPTIONS, LIMITATIONS, AND EXCLUSIONS

This Contract does not cover; a) damage to surfaces such as head liners, seat belts, dashboards, steering wheels or as determined by certain design characteristics of the vehicle, b) stains or damage caused by dye, ink, tar, gum, or paint; bleach, acid or other corrosive substances, c) burns, rips, tears, shredding or other interior fabric or leather damage resulting from vandalism or other causes, d) any item covered or protected under an insurance policy, the terms of the vehicle’s manufacturer’s warranty, a servicer or guarantee/warranty, or failures from which the manufacturer has announced its responsibility through a recall, technical bulletin (TSB) or any other announcement for the purpose of correcting such defect, e) any service or repair that involves updating or retro fitting the vehicle due to product changes, lack of product availability or government regulations, f) defects in the fabric, leather or vinyl materials installed by the manufacturer, g) fabrics, leathers or vinyl’s that have been damaged, chipped, burned, ripped, or torn due to abuse or alteration, h) any repair resulting from collision or accident; internal or external fire; theft; vandalism; riot; war; civil commotion; explosion; lightning; earthquake; hurricane; tornados; freezing, windstorm; water or flood; acts of God; i) any service required as a result of misuse; abuse; negligence or not protecting the vehicle from further damage when damage has occurred, j) any liability for property damage or for injury to or death of any persons arising out of the operation, maintenance or use of the vehicle, whether or not related to the parts covered, k) loss of time, profit, inconvenience, consequential damages, or any other loss that results from a failure, l) any information provided by the contract holder, issuing dealer or a repair facility that cannot be verified as accurate or is found to deceptively inaccurate, m) any repair not previously authorized by Radiant Ride and performed by an authorized technician, n) repairs of any components not specified under this contract, o) any repair occurring after the expiration of this agreement, p) any vehicle more than four (4) model years old at the time of registration, q) any vehicle over one ton or any commercial vehicle or vehicle used for commercial purposes including but not limited to; taxis, ride share vehicles, police cars, emergency vehicles, etc., r) Aston Martin, Bentley, Ferrari, Lamborghini, Lotus, Maserati, Maybach, McLaren & Rolls Royce vehicles, s) any pre-existing condition on the subject vehicle.

 

 

 

Keep Your Information Confidential

Those who access this site using confidential login information should keep their login information confidential. Your login information identifies you to this site. Anyone who has this confidential information can access your private account data.

 

Your obligations

When you use this Service, you agree:

  • To comply with these terms of use;
  • To provide accurate information;
  • Not to attempt to access any account without proper authority;
  • Not to attempt to access any non-public part of this site, unless you are authorized to do so;
  • Not to do anything that would interfere with the ordinary operation of this site;
  • To pay all charges authorized by you, even if your credit card company does not honor a charge;
  • Not to violate the intellectual property rights of Radiant Ride, or of others.

Radiant Ride reserves the right to terminate the use of this site by anyone who does not comply with these obligations.

Radiant Ride reserves the right to terminate your subscription and use of this site for excessive repair use and vehicle neglect. The customer should maintain proper appearance maintenance and car care cleaning.

Radiant Ride may give you notices either by posting them on this site, or by email if you have supplied an email address. You agree to check this site and the email address that you supplied for notices, and you will be deemed to have received a notice when it is posted on this site or sent to you by email.

The site is owned and operated by Radiant Ride. Unless otherwise specified, all information appearing on this site, including (but not limited to) text, site design, logos, graphics, icons, and images, are the sole property of Radiant Ride or its licensors. You may not reproduce, modify or distribute any of the content of this site. Radiant Ride owns all software. Without Radiant Ride’s prior written permission, no materials or images from this site may be copied, modified, uploaded, transmitted, or distributed in any form or by any means. All rights not expressly granted herein are reserved. Any unauthorized use of the materials appearing on this site may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties. ANY OTHER PROVISION OF THIS AGREEMENT NOTWITHSTANDING, VENDOR SHALL NOT BE LIABLE TO CUSTOMER FOR ANY ERROR OR DEFECT IN, OR FAILURE OF PERFORMANCE OF, OR WEB SITE. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

Internet Availability Disclaimer

THE INTERNET CONSISTS OF MULTIPLE PARTICIPATING NETWORKS WHICH ARE SEPARATELY OWNED AND THEREFORE ARE NOT SUBJECT TO THE CONTROL OF RADIANT RIDE. RADIANT RIDE’S ABILITY TO PROVIDE THE SERVICE DEPENDS ON INTERNET SERVICES PROVIDED TO RADIANT RIDE. MALFUNCTION OF OR CESSATION OF INTERNET SERVICES BY INTERNET SERVICE PROVIDERS OR OF ANY OF THE NETWORKS WHICH FORM THE INTERNET MAY MAKE THE SERVICE TEMPORARILY OR PERMANENTLY UNAVAILABLE. YOU AGREE THAT RADIANT RIDE SHALL NOT BE LIABLE FOR DAMAGES INCURRED OR SUMS PAID WHEN INTERNET SERVICES ARE TEMPORARILY OR PERMANENTLY UNAVAILABLE DUE TO MALFUNCTION OF, OR CESSATION OF INTERNET SERVICES BY, NETWORK(S) OR INTERNET SERVICE PROVIDERS, OR DUE TO ANY MISUSE, ACCIDENT OR ABUSE BY A USER.

 

Limitation of Liability

IN NO EVENT WILL RADIANT RIDE, ITS AFFILIATES, SUBSIDIARIES, AND RELATED COMPANIES, ITS ADVERTISING AND PROMOTIONAL AGENCIES, OR ITS DIRECTORS, OFFICERS, EMPLOYEES, ATTORNEYS, AGENTS, AND REPRESENTATIVES, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR OR ANYONE ELSE’S ACCESS TO AND USE OF THE INTERNET SITE OR THE DOWNLOADING FROM AND/OR PRINTING OF MATERIAL FROM THIS SITE, EXCEPT TO THE EXTENT OF PAYMENTS ACTUALLY RECEIVED THROUGH THIS SITE, LESS CHARGEBACKS. Privacy Statement Our Policy

As a customer of Radiant Ride, your privacy is our business. It is our policy to protect you and your family from unauthorized use of information provided in the course of doing business with us.

No information provided by you will be used for any purpose other than processing your on-line transactions for the Service. We will not give away, sell or otherwise disclose any information that personally identifies you, except as necessary to perform the Service. In addition, we may offer optional surveys or questionnaires to our users as a means of collecting demographic information or assessing users’ opinions, interests and needs. The survey will contain an explanation as to its proposed use.

What Information We Collect

We collect and retain information resulting from data you have entered into the Radiant Ride Service. This information may include login information you have entered into the Service and payments you have made through the Service. It may also include information entered by someone you have authorized to use the Service on your behalf (“Authorized Payor”).

In some cases your institution may provide the Radiant Ride service with information to assist with your transactions, such as balances due on your account, and repair history. Such information is only viewable by someone who has authorization to access that information (See Terms of Use, “Keep Your Information Confidential”).

Email Address

When you use the site, we request your email address. We may use your email address to send you receipt information, information about your transactions, and notices about this site.

Transaction Information

To process transactions, we collect information related to each transaction, such as the amount and the necessary identifying information, including the account numbers or email addresses of the parties involved.

Credit Card Verification Information

During the processing of transactions, we collect verification information from the credit card issuers. The credit card service verifies that the user’s credit card information and address match the information that the user supplies to Radiant Ride Service.

Automatically Gathered Information

Our site automatically gathers information about the type and version of your Web browser, so we can present the site to you properly, and keep a record of your activity at the site. This information is used to process transactions and provide the Service. We do NOT release an individual’s personal information without consent, except as necessary for these purposes. Information as to payments made will be released to your institution. However, your credit card number, bank account and routing number, and other financial information is NOT released. This limitation makes Radiant Ride Service transactions as private as dealing directly with your institution for payment. We will not give third parties individually identifiable information about users unless we are compelled to do so by law, or we have the express permission of the user, or we need to disclose it to process transactions. We may share aggregated statistical data with our business partners or the general public. For example, we may tell our Dealership Partner’s Service Centers that 30% of our users live in California.

 

Security

We use commercially reasonable efforts to maintain the security of your personal information. All identifier and transactional information collected by Radiant Ride is stored on a secure server. Any sensitive information is encrypted. Your private account information is stored on a server that is protected both physically and electronically.

Our servers are NOT directly connected to the Internet. They sit behind a firewall, which is designed to make private financial information available only to messages from authorized computers.

When you communicate with Radiant Ride through your computer’s Web browser, Secure Sockets Layer (SSL) automatically protects your interactions. Before you log into our site, our server checks to make sure you are using one of the approved browsers. We only support browsers that use SSL 3.0 or higher.

Every payment transaction is assigned a unique receipt number, and you, the user, for reconciliation and tracking purposes. Each transaction is also tracked by Radiant Ride and the date/time of your transaction.

 

 

Intellectual Property

The Website and its entire contents, features, and functionality (including but not limited to all information, text, displays, images, icons, video, and audio, and the design, selection, and arrangement thereof), are owned by Radiant Ride or other providers (where named) of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit personal, non-commercial, use of the Website only.  You are not authorized to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on our Website, unless otherwise permitted to do so by law or by advance written consent from Radiant Ride.  Nothing in the Terms transfers to you any right, title or interest in any content on the Website, including any intellectual property or content of third parties included on the Website.  You must not access or use any part of the Website, or materials available through the Website, for commercial purposes.

If you wish to use any material on the Website, please submit a written request to us via the “Contact Us” form.  Consent and/or permission can be granted or withheld at the sole discretion of Radiant Ride.  Failure to respond to any request does not constitute consent or permission in any case.

Trademarks

Radiant Ride, and affiliates and subsidiaries, and any other trademark owned exclusively by Radiant Ride, as well as most other product names and logos used by Radiant Ride on this Website are the trademarks or registered marks of Radiant Ride Inc.  These include all products, logos, phrases denoted with TM or ©, and all related names, designs and slogans are the exclusive ownership of Radiant Ride  Inc.  Trademarks of other parties are identified wherever possible and Radiant Ride acknowledges their rights.
